Section 17
Liability of insurer
(1) If the insurer, employee of the insurer, insurance agent or surveyor does any act against the rights and interests of the policyholders and causes loss, the insurer shall pay the compensation. If the liability is determined in such a way that the insured can file a complaint as specified in the committee. (3) If a complaint is filed according to sub-section (2), the committee will conduct necessary investigation on the said complaint and give the relevant insurer a reasonable opportunity to submit a clarification on the said complaint. (4) Sub-section (3) If the explanation submitted by the insurer is reasonable, the committee may open and dismiss such complaint and if the explanation is not reasonable, the committee will decide to give reasonable compensation to the complainant. (6) According to sub-section (4) if the decision of the committee is upheld on appeal against the decision made by the committee for the petitioner to receive compensation, the amount of interest at the prescribed rate shall be added to the compensation amount from the date of the initial decision to the date of final settlement of the case. The insurer must pay the insured immediately.
